17 July, when Dr Rajesh Sharma will speak on the topic ‘Resolving a Religious Dispute through Mediation in India’. A flyer is attached.
The background to the decades-long dispute, over a small piece of land (1500 square feet), is as follows. Hindus claim they should own the land because they believe Lord Ram was born on it, while Muslims consider it theirs, as a mosque was built there during Muslim rule in India. Riots and killings have resulted from the dispute, and in 1992, a Hindu mob destroyed the mosque. To avoid further religious or communal violence, the Indian government asked the High Court to rule on the matter. In 2010, the High Court, without resolving ownership, divided that land and adjoining land between Hindus and Muslims.
Unhappy with the decision, both sides have appealed to the Supreme Court of India. While the case is still pending, the Chief Justice has recently suggested that the parties attempt to resolve the issue through mediation. In his presentation, Dr Sharma will focus on the viability of the use of mediation to resolve the various issues involved in the dispute. Audience discussion is encouraged.
Dr Rajesh Sharma is a Senior Lecturer in Justice and Legal Studies, RMIT University, an accredited mediator at the Mainland Hong Kong Joint Mediation Centre, a panel arbitrator with the Korean Commercial Arbitration Board and a member of India International ADR Association. He is a Research Fellow of the International Academy of the Belt and Road and a member of that organisation’s DR Rules Drafting Committee.
